Walvis Bay Activities, its owners, employees, agents, and operators shall not be liable for any personal injury, death, loss, damage, expense, or consequential loss whatsoever, whether caused by negligence or any other cause.

You confirm that you are physically and mentally fit to take part and have no medical condition that could be aggravated by participation. You agree to follow all safety briefings and instructions given by the operators. We reserve the right to refuse or remove any person who appears unfit, intoxicated, or whose behaviour endangers themselves or others, without refund.

All bookings are subject to availability, weather, sea conditions, and operational requirements, and minimum numbers. We may cancel, postpone, or alter any activity at any time without prior notice. In such cases, we will try to offer an alternative or future date, but no liability is accepted for travel costs, accommodation, or any other expenses incurred. Refunds, if granted, are entirely at our discretion.

To the fullest extent permitted by law, Walvis Bay Activities excludes all liability for any loss or damage arising from your participation. These terms are governed by the laws of Namibia and any dispute shall be subject to the exclusive jurisdiction of the courts of Namibia.
